Who is the controller of your personal data?

What personal data do we process?
We process the personal data that you have provided to us when entering into an agreement (or agreements) with us, including data on your representatives, owners, or employees.
In this regard, we may process, in particular, the following categories of data:

  • Identification data (e.g., first name, last name, NIP, REGON);
  • Contact data (e.g., business phone number, business email, mailing address);
  • Financial and billing data (e.g., bank account number).

Why and on what basis do we process your personal data?
We process your data for the following purposes:

  • Preparation of the contract (basis: consent and contract, and if no contract is concluded – consent and our legitimate interest),
  • Execution of the contracts concluded with you (basis: contract),
  • Fulfilling our legal obligations, particularly those arising from tax and accounting law, as well as the Anti-Money Laundering and Counter-Terrorism Financing Act (basis: legal requirement),
  • Archival purposes, the pursuit of rights and claims, defense against claims (basis: our legitimate interest).

How long do we process your data?
For the duration of the contract binding us with you, but no less than until all of our due benefits under such contract have been settled. After this period, due to our legitimate interest, your personal data will be archived for a period of 5 years (calculated from the end of the year in which the contract ended) due to statutory requirements and for the purpose of defending against potential claims from you. The period may be extended if required by applicable law in Poland or the EU. In the case of no contract being concluded, for a period of 3 years from the end of negotiations regarding the conclusion of the contract, for the purpose of defending against potential claims.

Who do we share your personal data with?
We share your data with entities processing data on our behalf under data processing agreements, participating in carrying out our activities, such as:

  • Entities handling our IT systems or providing us with teleinformatic tools,
  • Entities managing our accounting,
  • Law firms and debt collection companies acting on our behalf.

Additionally, to courier companies and the Polish Post. Also, when required, we may share data with public authorities and institutions entitled to request access.

What are your rights in relation to the personal data you have provided to us?
You have the following rights, including the right to: (i) verify whether and what personal data about you we are processing, as well as to receive a copy of this data,
(ii) request the correction, completion, or deletion of your personal data,
(iii) request us to restrict the processing of your personal data,
(iv) in certain circumstances – object to the processing of your personal data or withdraw the consent you previously gave for processing, provided that the withdrawal of consent does not affect the lawfulness of processing that occurred before its withdrawal,
(v) request the portability of your data,
(vi) know the identity of third parties to whom your personal data is transferred, and
(vii) lodge a complaint with the President of the Personal Data Protection Office.
